A guardian in Virginia is a person designated to make personal decisions for a minor, such as where they will live and their educational needs. A conservator, on the other hand, is responsible for managing the child’s financial assets and resources. In many cases, the same individual is appointed as both the guardian and conservator, but that is not a requirement.
Designating a guardian/conservator is a proactive step towards safeguarding your child’s wellbeing in your absence. If no legal provision is made, the state of Virginia will determine the guardian and conservator for your child. This can lead to outcomes that may not align with your wishes, potentially causing stress and complications for your family.
